By using the services available through OurShelves.com, you are agreeing to the following terms. Before registering with OurShelves, you must read and accept all the terms and conditions in this User Agreement.

Using OurShelves

While using the services available through OurShelves.com, you will not:

  • list false information in your Account or “My Shelf”
  • use the site if you are under the age of 18 and cannot form legally binding contracts
  • fail to return borrowed items by the agreed date of return
  • significantly damage or mark borrowed materials without prior written consent from the lender
  • circumvent or manipulate our fee structure or billing process
  • take any action that may undermine the reputation system
  • distribute viruses or any other technologies that may harm OurShelves and its users
  • hack the site
  • harvest or otherwise collect information about users

Fees

There is no fee for purchasing items on our site. There is 15% processing fee for all transactions. After the buyer/borrower and the lender/seller agree to the terms of a transaction (the rate, lending period, etc.), 15% of the agreed price goes to OurShelves. The lender/seller receives 85% of the agreed price.

Managing Your Account

When depositing funds through Google Checkout into your OurShelves account, you must deposit a minimum of $2.00. You may withdraw all unrestricted funds at any time. Funds are unrestricted if they have been deposited by you directly into your account via Google Checkout. This also includes funds transferred to you as a direct result of a transaction on the site. Restricted funds are funds given to you as a coupon or credit through OurShelves. These funds cannot be withdrawn.

Liability

You will not hold OurShelves liable for other users’ actions. We cannot guarantee the quality, truth, or accuracy of listings. We do not transfer legal ownership of items from the seller to the buyer.

Release

If you have a dispute with a user, you release us from claims, demands, and damages of every kind and nature, known and unknown, connected in any way with disputes.

Dispute Resolution Policy

We expect you to treat your peers’ belongings with respect and behave in good faith. A dispute may arise if one of the following instances occurs:

  1. A lender does not receive his/her book or magazine on or before the agreed date of return.
  2. A borrower returns a book or magazine significantly damaged* or marked without prior written consent from the lender.

Resolution Process:
The parties are encouraged to communicate directly to resolve the issue.
If the parties cannot come to a resolution, OurShelves will conduct an investigation, resulting in possible refunds, at our discretion, and involvement with law enforcement.

*What is "significantly damaged"?

If the binding is torn, pages are missing, or the book or magazine is damaged in such a way that is not expected of typical use. Also, the borrower may not write in, or highlight the text without prior written consent form the lender.
